Identification of private information in social contexts
摘要
Abstract
The introduction of the concept of private information is one of the highlights of the Civil Code.Discussions on the protection mode,reasonable utilization,and application of protection rules for private information must be based on the identification of private information.Private information differs from general personal information in terms of the rights basis,content characteristics,and information processing rules,necessitating higher-level protection under privacy norms.Private information and sensitive personal information belong to different classification methods.Though they are not clearly distinguished,they cannot be equated.In terms of connotation,private information is distinguished by its secrecy,while sensitive information is marked by the high probability of causing psychological distress to the data subject upon disclosure.In terms of extension,the two exhibit a close relationship and often overlap each other.Typical private information is also sensitive.In terms of legislative value,Private information helps to categorize different types of privacy,distinguishing between privacy rights and personal information protection,while sensitive information helps to categorize within personal information protection.To break the dilemma of identifying private information:on one hand,typical private information should be explicitly listed,including financial information,personal history,medical and health data,biometric data,and genetic information.On the other hand,based on the social context theory,less apparent private information should be identified on a case-by-case basis,adhering to the principle of balancing data circulation and utilization with the protection of personal dignity.This entails a thorough assessment of factors including societal consensus,application scenarios,information content,data scale,processing methods,and potential harm.This paper categorizes typical private information,proposes a personalized approach to identifying private information based on social context theory,and concurrently facilitates the active disposition and reasonable utilization of private information.It bridges the privacy provisions of the Civil Code with the reasonable utilization system under the Personal Information Protection Law.Furthermore,through the concept of the information chain within social context theory,this paper elucidates how algorithms in the digital era influence the identification of private information.关键词
