摘要

Abstract

The advancement of autonomous driving technology has promoted the development of urban taxi industry.However,some platform enterprises occupies the market through low prices first and then raises prices to extract profits,which affected market order and consumer interests negatively.In essence,such practice is driven by the profit-seeking nature of capital.It is characterized by both exclusionary and exploitative features and falls within the scope of predatory pricing regulated by anti-monopoly laws.Under anti-monopoly law,the regulatory approach of predatory pricing in the context of autonomous driving may proceed along several paths.First,the platform's control over the relevant market can be identified by applying theories of economic dependence and transmission effects.Secondly,within a cost-price analytical framework,below-cost pricing by platform enterprises may be determined by reference to average avoidable cost.Thirdly,in case-by-case analysis,the"overall market price level"may serve as a substantive criterion for assessing competitive harm.Meanwhile,the functional positioning of"justifiable reasons"as a defense should be clarified,and a comprehensive judgment should be made from the dimensions of rationality and necessity to determine whether the predatory pricing in unmanned driving meets the requirements for exemption.
