The Application of the Principle of Proportionality in the Argumentation of Local Environmental Legislation

Abstract
The principle of proportionality,traditionally applied in ex-post reviews such as law enforcement and judicial scrutiny,can be extended to the ex-ante argumentation phase of local environmental legislation.This extension aims to structure and constrain legislative discretion,thereby preventing the dual pitfalls of regulatory"laxity"and"one-size-fits-all"overreach.Leveraging the accessibility and verifiability of legislative facts during the argumentation stage,this study constructs a specific framework for applying the proportionality principle.Within the suitability stage,the substantive connection between the legislative purpose and environmental public interest must be strictly examined,while a more lenient"supportability"standard is applied to assess the means-end relationship.The necessity stage requires the precise identification of"equally effective"alternative means,prioritizing regulatory tools that impose the least restriction on rights and interests.The core of the balancing stage is to determine whether the promotion of public interest and the restriction of private interests are"manifestly disproportionate",introducing the theory of"expectation possibility"(qidai kenengxing).This judgment should be based on the standard of ordinary social rationality and tolerance,informed through democratic legislative processes such as hearings and public consultations.This proposed framework seeks to rationalize and standardize the process of local environmental legislation,achieving a prudent balance between environmental public welfare and individual private interests.关键词
