The Establishment of the Judicial Application System for the Alternative Restoration Responsibility of Ecological Environment

Abstract
The alternative restoration responsibility of ecological environment represents a significant institutional innovation within ecological environment justice in response to ecological conservation.However,its application in judicial practice continues to face challenges such as ambiguous prerequisites and the absence of a clear hierarchy for selecting restoration methods,which results in inconsistent adjudication standards and difficulties in ensuring the effectiveness of restoration.Therefore,it is necessary to establish a judicial application system for the alternative restoration responsibility of ecological environment.By analyzing the legal attributes,clarifying the application prerequisites,and designing the application sequence,this system will provide clear guidance for judicial adjudication.First of all,it should be specified that the alternative restoration responsibility of ecological environment is an independent form of liability under the convergence of public and private law,aiming at restoring ecological functions,and it has both the functions of damage relief and responsibility pursuit.Then,the application of this responsibility should be fundamentally contingent upon the direct restoration being impracticable or incomplete,subject to normative prerequisites of substantive legitimacy and procedural fairness,while operational prerequisites of feasibility and relevance must be satisfied when selecting specific restoration methods.Finally,it puts forward an innovative three-tier methodological framework for application,that is,the rigorous selection of restoration responsibility,the accurate adaptation of restoration models,and the scientific choice of restoration methods,ultimately advancing the regulated development of judicial application of alternative restoration responsibility.关键词
