我国环境立法目的及伦理范式之批判
Critique of the Purposes and Ethical Paradigms of Environmental Legislation in China
摘要
Abstract
The proposal of the goal to build a Chinese path to modernization not only sets new requirements for China's environmental legislation but also points out the direction for the development of China's environmental ethics and the transformation of the purpose of its environmental legislation.The dual purposes of protecting the environment and promoting economic development under China's current environmental law,along with the subject-object dichotomy of metaphysical environmental ethics,can no longer meet the essential requirements of building a Chinese path to modernization.Therefore,under the guidance of the vision of harmonious coexistence between humanity and nature,environmental legislation should focus solely on the goal of promoting green development that fosters harmony between humanity and nature.Environmental ethics should recognize humanity's proactive and central role,and adopt a developmental,interconnected,and holistic perspective to understand the relationships between humanity and nature as well as among people themselves.Consequently,it should establish a people-centered environmental ethics of harmony between humanity and nature,clarify that the legislative purpose is to advance high-quality human development,and ultimately build an environmental legal system aligned with Chinese modernization.关键词
