农业数据共享赋能农业新质生产力的作用机理与法治应对
The Mechanism of Agricultural Data Sharing Empowering New Agricultural Productive Forces and the Rule of Law
摘要
Abstract
As the core driving force for the development of new agricultural productive forces,the process of rule of law of agricultural data sharing is directly related to the depth and effectiveness of agricultural digital transformation.Agricultural data elements are deeply coupled with the new agricultural productive forces.Agricultural data sharing can promote the qualitative transition of productive force by reconstructing workers,labor materials and labor objects,drive the paradigm change of agricultural production and the innovation of agricultural business entities,and promote the development and cross-border integration of industrial clusters.At present,the practice of agricultural data sharing is confronted with three dilemmas of lack of basic laws,lack of sharing rules and mismatch of guarantee mechanisms,which are manifested in ambiguity of ownership definition inhibiting the kinetic energy of data supply,absence of standardized rules hindering cross-domain circulation,single sharing mode reducing the allocation efficiency,unclear sharing content restricting the enthusiasm of subjects,security risks and regulatory fragmentation restricting the empowerment efficiency.In this regard,on the basis of balancing the public welfare attributes of agricultural data with private interest incentives,security and development goals,we should build a"dynamically compatible"ownership structure,strengthen the construction of data standardization,design appropriate sharing operations and incentive rules to solve circulation obstructions,improve the hierarchical protection system,rely on privacy computing technology and collaborative supervision mode to prevent data risks,ensure the safe and efficient circulation of agricultural data with the path of rule of law,and promote the development of new agricultural productive forces and transformation of agricultural modernization.关键词
