外商独资医院医疗风险分担的制度构建
Institutional framework for medical risk allocation in wholly foreign-owned hospitals

Abstract
Openness is a defining feature of Chinese modernization,and opening up the healthcare sector to the outside world has become an important component of this process.Against the backdrop of high-level opening-up in the healthcare field,wholly foreign-owned hospitals,as a newly emerging type of medical institution,exhibit medical risk structures that are both gen-eral in nature and distinctive in form.Existing legal mechanisms for medical risk sharing,such as the"three forms of mediation and one insurance"framework,have accumulated relatively mature practical experience in public and private hospitals.Howev-er,within the new institutional context of wholly foreign-owned hospitals,these mechanisms have yet to develop a systematic and targeted regulatory response.In this regard,an examination of the values of justice,equality,and order underpinning medical risk-sharing mechanisms for wholly foreign-owned hospitals,together with the formulation of feasible institutional arrangements from both internal and external systemic perspectives,may contribute to balancing development and security and to safeguarding high-level opening-up in the healthcare sector through the rule of law.关键词
