Abstract

Although broad consensus has been reached regarding the motivations and conditions for national legislation on life-long learning,legislative progress has long been impeded by deep-seated controversies over its positioning,framework,and content.To address this impasse,this study draws on legislative systems theory to construct a systematic solution that integrates values,struc-ture,and effectiveness.At the value level,the fundamental purpose of legislation is clarified through a dual objective framework com-bined with a rights-priority principle,while a resource allocation principle that balances fairness and efficiency is proposed to recon-cile disputes over legislative positioning.At the structure level,the study adopts a"holistic education"perspective and advances a legislative approach characterized by"specialized legislation with systemic coordination."This includes a gradual implementation pathway,a model of"central framework legislation with delegated local rule-making,"and a responsibility allocation mechanism based on"minimum quantitative standards and incentive compatibility,"thereby addressing controversies surrounding legislative framework and content.At the effectiveness level,the study clarifies the legal nature of a"learning law"and its dual-rights founda-tion,constructs a mechanism combining the legalization of claims with diversified remedies,and proposes the establishment of a com-petency-based qualifications framework alongside a governance paradigm that integrates rigidity and flexibility,so as to ensure the ef-fective implementation of legislation.This study provides a systematic theoretical blueprint and practical support for the formulation of a scientifically grounded,operable,and forward-looking Lifelong Learning Promotion Law.
