Rethinking informed consent:A contextual theory perspective and its implications
摘要
Abstract
In the digital era where generative artificial intelligence technologies represented by DeepSeek deeply empower new productive forces,the paradigm of personal information processing has moved beyond the single dimension of traditional privacy protection and evolved toward a dual balance between the protection of personal information rights and the exploration of the economic value of data.However,the traditional informed consent model,due to its lack of flexibility and contextual adaptability,faces significant challenges in complex algorithm-driven data processing environments.These challenges include the weakening of the rights of information subjects and the institutional burden imposed on information processors.Although the principle of informed consent remains irreplaceable,it requires reconstruction while adhering to its fundamental legal rationale.By introducing contextual theory,scenarios can be categorized based on the types of personal information and the stages of information processing.Through the combination of horizontal and vertical scenario classifications,differentiated informed consent models can be applied to different types of information across varying contexts.With the support of the principle of proportionality to establish standards for exception review in special scenarios,a new informed consent framework-characterized by scenario-based,hierarchical,and stage-based structures with risk control as its core standard-can be formed.This approach ultimately aims to achieve an organic balance between personal information protection and socio-economic development in the digital age.The contextual adaptation of the new informed consent model includes four aspects:for general personal information,a circulation-promoting mechanism dominated by consent exemptions should be adopted;for important personal information,a dynamically adjustable mechanism under a framework of presumed consent should be applied;for sensitive personal information,a strengthened protection mechanism should be implemented,with mandatory consent as the principle and consent exemption as the exception;and for data processing scenarios involving DeepSeek,the new scenario-based informed consent model should be applied.关键词
