超越冲突:数据要素市场中的多重制度逻辑嵌合与协同治理
Transcending Conflicts:The Interlocking of Multiple Institutional Logics and Collaborative Governance in the Data Element Market

Abstract
Against the backdrop of the simultaneous advancement of digital government and the dig-ital economy,the development and level of marketization of data elements are profoundly influenced by multiple institutional logics.In particular,conflicts and frictions among the state logic,bureau-cratic logic,market logic,and social logic have become critical factors constraining the efficient al-location of data element market and the release of data value.The study reveals three core institu-tional logic conflicts,namely,the goal misalignment between"unified regulation"and"territorial competition"between central and local governments,the role conflict between"public authority in-tervention"and"private order autonomy"between government and market,and the value division between"capital expansion"and"rights protection"between market and society.The effective gov-ernance of the data element market requires institutional design to achieve logical integration.This can be realized by constructing a closed-loop mechanism linking central and local governments,es-tablishing an iterative mechanism for government-market collaboration,and improving a balancing mechanism for market-society interaction.These mechanisms aim to promote institutional integra-tion in defining data ownership,facilitating data circulation and trading,and ensuring secure data u-tilization.关键词
