Realistic Challenge and Path Optimization of Algorithmic Administration in the Exercise of Administrative Discretion

Abstract
In the context of administrative law,the exercise of administrative discretion is consist-ently subject to the dual constraints of fundamental principles and normative rules.With the em-bedding of algorithmic technology,the model of administrative decision-making is undergoing a par-adigmatic shift from experience-based judgment to data-driven governance.While this transforma-tion enhances governance efficiency,it also brings a series of challenges to algorithmic administra-tion,including reduced procedural transparency,intensified duties to give reasons,the absence of clear standards for algorithmic application,and the limited intelligibility of administrative acts.More specifically,the relevance of data input and output,the risk assessment of algorithmic predic-tion,and the accuracy and overall correlation of algorithmic prediction together constitute important drivers reshaping the traditional rules governing the exercise of administrative discretion.The path of institutional optimization should proceed on the premise of clarifying the scope and boundaries of administrative discretion,affirming the dominant role of human decision-makers,promoting the continuous calibration and dynamic updating of algorithmic models,and improving the operational framework of algorithm-assisted discretion,so as to give full play to the effectiveness of algorithmic tools in administrative governance.关键词
