数字资产继承的利益诉求与流转规则
On Claims of Inheritance Interests and Their Circulation Rules for Digital Assets

Abstract
Disputes over the inheritance of digital assets have exposed the limitations of the Civil Code in terms of abstract provisions and vague application standards.The academic community has not yet resolved the discrepancies between legal attributes(the mainstream of composite property)and inheritability(the dualistic dispute between personal attributes and property),and there is an urgent need to build a systematic framework of"principles and exceptions"through judicial interpretation.On the premise of inheritance,it is necessary to break the traditional concept that"personalized digital assets are absolutely not inheritable",and at the same time,according to Article 496 of the Civil Code,the platform restrictive provisions of the interpretation of the"relative invalidity"of the platform,to create institutional space for the inheritance of digital assets.In terms of inheritance logic,a dynamic balancing mechanism should be constructed to reduce the waste of idle assets and safeguard the legitimate rights and interests of all parties by coordinating the adverse interests of the decedent and the heir as well as the risky-based benefits and counterclaims of the network service provider.In terms of inheritance rules,Article 1122 of the Civil Code should be interpreted in a standardized manner,establishing the principle of being"inheritable generally but restrictive in special situations",and creating"restrictive inheritance"rules for special situations involving public interests while safeguarding the basic disposal rights of heirs.关键词
