Abstract
[Purpose]The United States has systematically incorporated national security review mechanisms into patent invalidation pro-ceedings.This approach weaponizes the patent system,posing a significant threat to the development of specific applicants and key techno-logical sectors,while simultaneously undermining the existing global intellectual property governance framework.In-depth research into its specific impacts and the formulation of systematic response strategies are of paramount importance.[Method]This research integrates public policy analysis,legal interpretation,and strategic studies to evaluate the specific impacts of the policy across three interrelated di-mensions:enterprise,industry,and governance.The analysis follows a multi-tiered approach,examining the macro-level authorization of administrative orders,the meso-level reshaping of institutional attributes,and the micro-level revision of procedural rules,ultimately constructing strategic responses grounded in systems theory.[Result/Conclusion]The new measures represent a historic expansion of the United States'national security review scope,exacerbating the political risks associated with intellectual property disputes.In order to es-tablish a systematic defense and countermeasure system,macro-level responses should seek legal certainty within a multilateral framework;meso-level adjustments should improve patent invalidation and judicial review procedures,building an equal deterrent capability;micro-level measures should guide market entities in developing overseas risk plans,establishing a united front against the abuse of intellectual property.关键词
