Legal narrative,mode dispute,and improvement approach of local legislation on technological innovation:Sample analysis based on local legislation on scientific and technological innovation in 31 provinces

Abstract
Technological innovation is the core element of new-quality productive forces.Developing new quality productive forces in accordance with local conditions through the rule of law hinges on strengthening local legislation on technological innovation.Based on an analysis of the local regulations on technological innovation across 31 provinces in China,this study finds that current local legislation features the coexistence of comprehensive legislation and special legislation.Although the legislative structure largely follows higher-level laws,it has also achieved innovative breakthroughs,and exhibits the characteristics of regional concentration and significant differentiation.In terms of legislative philosophy,local legislation on technological innovation should primarily adopt a promotional approach.In terms of legislative model,comprehensive legislation should play a dominant role,supplemented by special legislation.Specifically,it is advisable to integrate the general legislative principles with creative characteristics,build a basic framework contered on core elements such as"talents","enterprises"and"achievement transformation",and foster a virtuous cycle among education,science and technology,and talent development.Moreover,coordination and openness should be strengthened,and systematic,standardized and digital legislative techniques should be employed to promote the integrated development of technological innovation elements,thereby to enhance governance effectiveness in terms of creativity,efficiency,and contemporaneity.关键词
