社交电商平台数据产权登记的理论基础与制度建构
Theoretical basis and institutional construction of data property registration on social e-commerce platforms

Abstract
Data property rights registration is a key system for realizing the orderly circulation of data elements of social e-commerce platforms in the digital economy era.Currently,the practice of data property rights registration on social e-commerce platforms suffers from problems such as unclear registration targets,a lack of diversity in reviewing entity,and vague review standards,leading to unsatisfactory implementation results and difficulty in implementing administrative supervision by authorities of social e-commerce platforms.The theory of data element-based governance and the theory of data governance interaction jointly constitute the theoretical foundation for the governance of data ownership registration on social e-commerce platforms.The theory of data element-based governance emphasizes facilitating the market circulation of data on social e-commerce platforms and promoting the release of data value.The theory of data governance interaction requires the participation of multiple stakeholders in the data property rights registration process on social e-commerce platforms to achieve value sharing.As a core of digital economic development,the data ownership registration mechanism for social e-commerce platforms should accelerate the construction of a three-dimensional regulatory framework centered on registration targets,review bodies,and review standards.It should improve the collaborative mechanism that integrates accurate identification,scientific classification,and boundary definition of registration targets;establish a multi-governance mechanism involving platform self-review,administrative supervision,and industry self-regulation,and construct a formal and substantive review mechanism centered on data element value assessment.关键词
