The Modern Application Pathway of She Ethnic Custom under Judicial Introduction

Abstract
Custom refers to behavior norms of interaction that are spontaneously formed by social subjects in a particular region based on certain production and living conditions,and subsequently develop external binding force.Over a long period,and within the framework of national laws,policies and coercive force,She ethnic custom has undergone a natural evolution at the normative level.Driven by the urgent needs of national rule of law construction and the objective reality of social interactions,the modern application of She ethnic custom has been revitalized.In modern judicial practice,allowing She ethnic custom to play the supplementary role precisely reflects a recognition and respect for the living pattern of the She people.From the perspective of legal application,we should make full use of judicial introduction channel and overcome the practical barriers posed by the strict dichotomy theory.Through judicial introduction,we can gradually achieve typologization and validation of She ethnic custom,thereby completing the construction of modern application pathway for the custom.关键词
