Multiple Logics,Practical Dilemmas,and Path Choices for Judicial Recommendations Empowering the Modernization of Social Governance

Abstract
As a judicial mechanism with Chinese characteristics,judicial recommendations have important theoreti-cal and practical significance for promoting the modernization of social governance.In the context of social gover-nance modernization,this paper systematically examines the points of convergence between judicial recommenda-tions and the modernization of social governance from both theoretical and practical perspectives.At the same time,it highlights the functional role of judicial recommendations and focuses on their current application in the practice of social governance modernization,accurately identifying the objective problems that constrain judicial recommen-dations at three levels:scale,policy,and effectiveness.Finally,to better realize the function and effects of judicial recommendations in promoting the modernization of social governance,it is necessary to build a"rule-of-law guar-antee"for social governance from three aspects:expanding application domains,strengthening policy guidance,and enhancing coordination and linkage.关键词
