Regulatory Optimization of Data and Algorithm Related Unfair Competition in Online Games
摘要
Abstract
Online games yield substantial economic benefits,and their development and operation are highly reliant on data and algorithms at the technical level.Currently,unfair competition involving data and algorithms is frequent and diverse in the online gaming industry.Noticeable bottlenecks still exist in the regulation of such unfair competition:the subjects entitled to game data rights and interests are unde-fined,the scope of protection for game data rights remains unclear,algorithmic infringements are hard to identify explicitly,and the measurement criteria for multiple interests within the online game industry ur-gently require clarification.It is critical to judicially refine the judging criteria for"business ethics"in the Anti-Unfair Competition Law of the People’s Republic of China,flexibly apply"data special funds",and regulated unfair competition behaviors related to data and algorithms in this field in a targe-ted manner.Furthermore,more attention shall be paid to the balance of multiple interests,the efficiency of administrative supervision shall be improved,and timely,precise and penetrating regulation shall be a-chieved.关键词
