Closure of digital platform ecosystems and antitrust regulation
摘要
Abstract
The closure of digital platform ecosystems refers to a situation where platform operators,capitalizing on their competitive advantages,build ecological barriers.Such closure restricts fair competition and innovation when erodes consumer rights and results in a digital economy that is large but not strong.Traditional antitrust frameworks encounter limitations due to the ill-defined boundaries of relevant markets,the inadequacy of established dominance assessments,and the challenges in quantifying competitive harm.However,the ex ante regulatory system is inefficient due to fragmentation.Consequently,based on the operational dynamics of digital platform ecosystems,this paper proposes that the concepts of business ecosystems and dynamic competition are integrated.The entire digital ecosystem should be regarded as the relevant market so as to comprehensively determine its market dominance and competitive detriment.Simultaneously,a dual ex ante regulatory mechanism combining platform self-governance with government oversight should be instituted to achieve an institutional equilibrium between innovation and competition.关键词
