A Study on the Copyrightability of AIGC Artistic Works
摘要
Abstract
The issue of copyrightability of artistic works generated by artificial intelligence(AIGC)originates from the impact of the human-machine collaborative creation model on the author-centered and originality theory of traditional copyright law.Therefore,it is necessary to shift the perspective from author-centered to work-centered,and establish a comprehensive originality judgment system based on the creative process,focusing on human creative contributions in processes such as prompt design,parameter setting,iterative optimization and final selection.it is advisable to establish the rights attribution principle that rights are granted to the user who makes the"decisive intellectual contribution",and explore the introduction of differentiated protection mechanisms and reasonable limitations on rights,so as to balance the incentive for innovation and public interest,thereby providing stable institutional expectations for AIGC artistic creation.关键词
