公共卫生委托执法向授权执法模式转型研究
Study on the Transformation of Public Health Law Enforcement From Administrative Entrustment to Authorization-Based Enforcement

Abstract
China's public health law enforcement has long relied on the model of administrative en-trustment,although this model has,to some extent,compensated for the deficiencies of administrative agencies in terms of professional expertise and enforcement resources,its functionally rational orientation entails inherent theoretical contradictions.In practice,these contradictions are manifested most promi-nently in the non-delegable nature of public health enforcement powers,insufficient legality,and the re-stricted application of administrative coercive measures.As a result,the legality and accountability of public health law enforcement are weakened,thereby giving rise to the crises of legitimacy.Based on the evaluative criteria of the legality of power sources,the consistency between powers and responsibilities,and the legitimacy standards of purposiveness and social trust,the administrative entrustment mode in public health law enforcement should be replaced by a standardized authorization-based enforcement mode,supplemented by sound procedural controls and resource guarantee mechanisms,so as to reconstruct the legitimate foundation for the creation and operation of public health enforcement powers.关键词
