Abstract
Under the promotion of the"double carbon"goal,new energy industries such as wind power and photovoltaics have expanded rapidly,but the tension be-tween their low-carbon values and ecological negative externalities has become in-creasingly prominent,and it is concentrated in environmental legal conflicts such as space control,rights infringement,norm adaptation and interest imbalance.The es-tablishment of the"Ecological Environment Code"and"Green Low-carbon Devel-opment Series"in 2026 provides a codified response to the environmental govern-ance of the new energy industry,and also constitutes the institutional background for the study of the legalization and reconciliation of environmental conflicts in the new energy industry.The research focuses on the normative application and system interpretation of the'Ecological Environment Code',and takes the wind power and photovoltaic industries as typical samples to systematically clarify the legal basis and institutional evolution of the environmental legal protection of the new energy industry.Based on this,the normative nature and legal causes of the core environ-mental legal conflicts in industrial development are deconstructed.Finally,the sys-tematic reconciliation path of environmental conflicts that fits the code system,cov-ers the whole life cycle of the industry,and connects public law control and private law relief is proposed.It is concluded that only by following the principle of ecologi-cal priority,relying on the code norms,making up for the shortcomings of the sys-tem,strengthening closed-loop supervision,improving the rights and interests relief mechanism,and improving the co-governance model,can we truly make the devel-opment of new energy industry,ecological environment protection and residents rights and interests protection work together and promote each other,and also build a solid and reliable rule of law foundation for the timely realization of the goal of"double carbon".关键词
