《港口国措施协定》履约评价与能力建设探析
Analysis on the implementation evaluation of the Port State Measures Agreement

Abstract
In order to further clarify the effectiveness of the implementation of the Port State Measures Agreement(PSMA)since its entry into force and the performance of the contracting states in fulfilling their obligations,a systematic comparison of the compliance capabilities of countries at different levels of development was conducted,and the core capability gaps were further identified.This paper adopts methods such as literature research,case analysis,and quantitative assessment of policy texts to sort out the relevant literature and meeting minutes of the PSMA to clarify the capability requirements,select 30 contracting states to analyze the effectiveness of compliance,and construct an importance index(Ic)to identify the key capability gaps.The results show that the implementation effect of the agreement by developing countries is less satisfactory,and the capability gaps and compliance difficulties mainly concentrate in areas such as information verification capabilities,port inspection systems,funding mechanisms,and domestic law conversion.The research indicates that some countries face difficulties such as insufficient designated ports,insufficient inspection capabilities,lack of legal guarantees,and insufficient information exchange.Through the construction of a hierarchical optimization system for information exchange,increasing legal credit for information sources,and joint law enforcement by administrative institutions,this study can improve the implementation performance of the Port State Measures Agreement and provide reference and theoretical support for China's effective compliance.关键词
