《生态环境法典》中的可再生能源规范及其与相关立法的衔接协调
Renewable Energy Regulations in the Ecological and Environmental Code and Their Coordination with Related Legislations

Abstract
The Ecological and Environmental Code regulates the development and utilization of renewable energy from the perspectives of ecological civilization construction and green and low-carbon transformation,which reflects a holistic approach to ecological protec-tion and demonstrates the systemic advantages of codification in terms of the normative arrangement,legislative orientation,and rule formation.Following the promulgation of the Code,the existing legal framework governing renewable energy exhibits significant discrep-ancies in guiding principles and conceptual expressions.In addition,there are also conflicts among major institutional arrangements,normative deficiencies and insufficient coordination between the renewable energy system and the ecological and environmental protec-tion system.To promote the coherence between the Code and related legislations,including the Energy Law,the Renewable Energy Law,and the Electricity Law,the principle of unity of legal order should be adhered to,with the objective of achieving both value co-herence and normative consistency in the legal regulations for renewable energy.The principal approaches include the following as-pects:firstly,adhering to the concept of sustainable development,unifying core concepts,fully implementing the principle of prioritiz-ing renewable energy;secondly,clarifying the renewable energy consumption guarantee mechanism in the Renewable Energy Law and related legislations,establishing market-based pricing mechanism for renewable energy,improving the renewable energy consumption promotion system as well as guarantee systems for transmission and storage;and meanwhile strengthening the coordination between the renewable energy system and the ecological and environmental protection system.Only in this way can be formulated a renewable ener-gy regulatory framework characterized with unified conceptual values,coordinated institutions,and comprehensive rules.关键词
