Regulation on the Abuse of Data Standard Rights through Standardization Law

Abstract
Data standards are a kind of public good in the digital economy market,possessing non-market characteristics.The characteristic of data standard right abuse lies in the fact that enterprises leverage the influence of data standards to control resource allocation.This paper explains that the standardization law aims to break down the closed resource allocation model by openness of standards and external regulatory enforcement.This regulatory strategy overcomes the self-isolation and restricted resource circulation formed by enterprises under the shield of private property rights,utilizing market supervision with external coercive power.The design of a legal framework must realize the leading role of the standardization law,and effective data standards supervision.The core contents of a well-developed legal system include curbing the fragmentation of data standards,establishing complete procedures for data standards development,introducing a regulatory system based on metadata standards,and promoting specialized legislation of standardization regulation departments for different stages.关键词
