Institutional Review and Improvement Pathways for the Legal Framework Governing Ecological Protection Planning Under Implementation of the Ecological and Environmental Code

Abstract
Integrated ecosystem management,as a fundamental methodology for ecological protection legislation in the new era,has driven the conceptual renewal and institutional restructuring of the legal framework governing ecological protection planning,which has been systematically constructed by The Ecological and Environmental Code through enhanced systematization and legalization.Never-theless,the existing legal system is still confronted with four major challenges,namely,the lack of a foundational meta-concept and the imperative of institutional reconstruction,the absence of key elements and ambiguity in coordination mechanisms,the tension between departmental compartmentalization and holistic systemic governance;and the constraints posed by interdepartmental barriers in the con-text of digital governance transformation.The core rationale for its construction lies in understanding the principle of statutory planning from both formal and substantive rationality perspectives,establishing a pyramid-shaped planning system with incorporation of a system/region-element governance framework,strengthening the coordination between planning institutions and related regulatory mechanisms,and embedding digital governance principles throughout all stages of the planning legal framework.Specifically,optimization efforts should focus on the following aspects of elevating ecological protection-related planning as a meta-concept to facilitate re-systematization of the planning legal regime at the level of legal interpretation,instituting a statutory catalogue and full-process supervision mecha-nisms,formulating guidelines for natural resource conservation and utilization plans to promote the integration of multiple plans at the municipal and county levels,and leveraging legislative experiences from other jurisdictions to enhance the legislative safeguards for dig-italization in China's planning governance,thereby facilitating its digital transformation.关键词
