数据交易监管制度的现实困境与优化路径
The realistic challenges and optimization paths of data trading regulatory systems

Abstract
The principles of prioritizing security alongside freedom,balancing rights and interests,and adopting an inclusive and cautious regu-latory approach are not only the value orientations of data transaction regulatory systems across different regions,but also the fundamental guidelines for further optimizing these systems.Based on an examination of provincial-level data-related local regulations,it was found that there are significant differences in legislation across various regions.The data transaction regulatory system still faces practical challenges such as unclear entities and responsibilities for transaction regulation,the absence of regulatory rules for different modes of data transactions,and in-consistencies in data transaction monitoring measures and standards.In order to establish a scientifically sound and reasonable data transaction regulatory system,future nationwide legislation will need to fully extract the institutional essence of local legislation,and systematically optimize the system by clarifying the entities and responsibilities for data transaction regulation,standardizing the regulatory rules for different modes of data transaction,and unifying data transaction monitoring measures and standards.关键词
