Terminology Selection and Conceptual Clarification of"Intelligence"Within the National Intelligence Law
摘要
Abstract
[Purpose]This study addresses key issues under China's national intelligence law concerning the contentious use of the term"intelligence",gaps in conceptual definition,and ambiguities in its scope and classification.It aims to clarify this foundational concept,thereby providing theoretical and practical support for refining China's intelligence legal system and advancing the modernization of national governance.[Method]Guided by a holistic approach to national security as the overarching principle,this study draws upon the National Intelligence Law of the People's Republic of China,the National Security Law of the People's Republic of China,the Counter-Espionage Law of the People's Republic of China,the Counter-Terrorism Law of the People's Republic of China,and the National Secrets Protection Law of the People's Republic of China as primary legal foundations.It incorporates relevant domestic and international theories and prac-tices,employing interdisciplinary approaches,literature analysis,empirical research,and comparative studies.[Result/Conclusion]Un-der China's national intelligence law,the term"intelligence"requires no prefix such as"national security",as its designation inherently encompasses both national security and development dimensions.This aligns with the guiding principles of intelligence legislation,the in-trinsic logic of legal provisions,relevant international legislative experience,and historical traditions in intelligence studies.Conceptually,"intelligence"under China's national intelligence law should be explicitly defined as:information products lawfully collected,analyzed,and processed by national intelligence agencies to safeguard state power,sovereignty,unity,territorial integrity,public welfare,sustain-able economic and social development,and other major national interests,thereby providing reference for major state decision-making and support for preventing and mitigating risks that endanger national security.关键词
