The Boundaries,Evolution, and Reconstruction of Jurisdiction over International Submarine Cable Security
摘要
Abstract
International submarine cables have the attributes of critical infrastructure,cross-border communication channels and de facto global public goods, and their security risks are concentrated in the institutional tensions surrounding jurisdictional boundaries under the law of the sea.Although UNCLOS establishes a graduated jurisdictional framework, four normative gaps remain:the separation between prescriptive and enforcement jurisdiction, unclear due-regard standards, insufficient rules on intentional damage and grey-zone conduct, and inadequate provision of global public goods, all of which constrain governance effectiveness.International judicial practice, alternative legal regimes and state practice are driving the evolution of jurisdictional boundaries through limited reinforcement, supplementary application and functional expansion.China should therefore adhere to the holistic approach to national security and improve specialized legislation,criminal-law application, procedural enforcement and international rule-making.关键词
