体育规则技术性治理的伦理风险与规制策略
Ethical Risks and Regulatory Strategies in the Technical Governance of Sports Rules
摘要
Abstract
To elucidate the evolutionary logic of sports rules'technical governance and its concomitant ethical risks,this study takes beach volleyball as a paradigmatic case.Drawing on the Beach Volleyball Rules and the Video Challenge System Rules issued by the Fédération Internationale de Volleyball(FIVB)from 2001 to 2025,the analysis integrates theoretical frameworks of techno-politics,co-production,procedural justice,and technological fairness.The study conceptualizes this governance as a normative practice mitigating competitive uncertainty via quantifiable parameters,closed procedures,and technological apparatuses,with an evolutionary trajectory marked by sequential parameterization,proceduralization,and evidentialization.While enhancing managerial efficiency and adjudicative consistency,this paradigm precipitates four ethical perils:conditional deviations in the realization of fairness;structural reconfigurations of arbitral subjectivity and authority;interpretive and remedial gaps in procedural justice;and expanding liability boundaries alongside rights vacuums in data production.Accordingly,regulatory strategies centered on"responsibility embedding"are proposed:at the rule-making level,positioning responsibility allocation as a prerequisite constraint for clause design;at the technological operational level,institutionalizing the human-machine division of labor and technological uncertainty;at the supervisory and remedial level,constructing accountability and relief mechanisms for technical adjudication;at the data governance level,anchoring data responsibility boundaries and filling rights vacuums,thereby ensuring that technical governance genuinely serves the institutional goals of competitive sports.关键词
