数据权益客体的层级式识别:理论反思与路径重塑
Hierarchical Identification of Data Rights Objects:Theoretical Reflection and Pathway Restructuring
摘要
Abstract
The identification of objects is decisive for property rights confirmation,and the identification of data rights objects is a fundamental issue in the construction of a data property rights system.Existing research on data rights objects is one-dimensional,and the basic concepts of data are unclear.To clarify the concept of data rights objects and reveal their essence,a hierarchical object identification rule can be established.In the horizontal dimension of data rights object concept construction,by distinguishing between data and information,it is clarified that data are represented at the physical layer,the symbolic layer,and the content layer.Thus,data as a data rights object refers solely to data at the symbolic layer.In the vertical sequence,the diverse types of data rights objects are clearly defined:raw data represents the initial form of data,while data resources and data products are identified based on the criteria of"processed"and"substantially processed"respectively.This forms a hierarchical flow pattern of"raw data-data resources-data products"with the evolution of data forms as the surface clue and the realization process of data value as the internal clue.关键词
