算法推荐诱导沉迷风险防范法律机制研究
Research on Legal Mechanisms for Preventing Addiction Risks Induced by Algorithmic Recommendations
摘要
Abstract
The widespread application of algorithmic recommendation technology has not only enhanced the efficiency of information distribution but also triggered social risks such as user addiction.Based on the theories of risk society,algorithm ethics,and negative externality correction,this paper examines the current legal mechanisms for preventing addiction risks induced by algorithmic recommendations in China,and finds that there are deficiencies in the obligation allocation,liability determination,procedural guarantee,and government supervision mechanisms.Therefore,it is necessary to clarify obligation subjects and refine obligation contents to improve the obligation allocation mechanism;clarify liability subjects,establish scientific standards and construct a hierarchical liability system to optimize the liability determination mechanism;open up channels for relief rights,activate the class-action lawsuit mechanism and improve evidence rules to complete the procedural guarantee mechanism;enhance regulatory capabilities,enrich regulatory tools and strengthen regulatory collaboration to innovate the government supervision mechanism.Thus,it can enhance China's digital governance capabilities and maintain a sound digital ecosystem.关键词
