Comparative Study of Chinese and Foreign Personal Data Protection Laws and Policies in the Context of Generative Artificial Intelligence and its Implications

Abstract
In the context of Generative Artificial Intelligence(GenAI),quantitative evaluation and comparative analysis of Chinese and foreign legal policies on personal data protection can provide valuable references for China to strengthen its capacity in governing personal data risks amid GenAI applications.This paper employs the Latent Dirichlet Allocation(LDA)model to extract topics from 39 legal and policy texts.Drawing on existing research,it constructs an evaluation system for legal policies on personal data protection in the GenAI era,and applies the Policy Modeling Consistency(PMC)index model to quantitatively assess 29 implemented policies from the samples.Furthermore,it compares policy differences among China,the United States,the United Kingdom and the European Union in terms of policy functional positioning,implementation logic and system completeness.Based on the comparative findings,the paper distills implications for China from three perspectives:balancing security and development,advancing agile governance,and fostering multi-stakeholder coordination,so as to offer references for enhancing the level of personal data protection in China against the GenAI backdrop.关键词
