Boundary Analysis of Legal Obligations for Energy and Chemical Enterprises to Participate in Ecological Protection under Ecological and Environmental Code

Abstract
The promulgation and implementation of the Ecological and Environmental Code of the People's Republic of China(hereinafter referred to as the Ecological and Environmental Code)provides a systematic and codified institutional basis for the rule-of-law construction of ecological protection in China,and a more comprehensive legal framework for energy and chemical enterprises to fulfill their ecological protection obligations.Based on the requirements of the Ecological and Environment Code,combined with and the practical operations of energy and chemical enterprises,this paper constructed an analytical framework that integrates legal provisions,corporate activity stages,and modes of obligation fulfillment according to the differences in normative functions,applicable links and constraint modalities of legal provisions.The mandatory obligations of enterprises in ecological protection were mainly summarized into several aspects:ecological and environmental access and compliance management,land-use,sea-use and shoreline protection,mineral resource development and mine area restoration,water resource utilization and aquatic ecological protection,species protection and habitat avoidance,and prevention and restoration of ecological degradation.It aimed to provide a clear normative guidance for energy and chemical enterprises to accurately grasp the requirements of the Code and shift from"passive compliance"to"active protection",and thereby promoting the synergistic advancement of high-quality corporate development and high-level ecological protection.关键词
