How the Strengthening of Collective Forestland Property Rights Affects the Effectiveness of Rural Governance in Mountainous Areas:A Theoretical Analysis from the Perspective of Property Rights Public Domain

Abstract
From the analytical perspective of the public domain theory of property rights,this paper explores the influence mechanism of the strengthening of collective forestland property rights on the effectiveness of rural governance in mountainous areas.The study finds that the ambiguity of collective forestland property rights gives rise to two types of property right public domains,namely legal discrimination and constrained behavioral capacity,which trigger rent-seeking,rent-chasing and rent dissipation in rural society.This not only intensifies multifaceted conflicts among forest households and between forest households and grassroots governance subjects,driving up the non-productive costs of rural governance,but also leads to the inefficient use of forestland resources and the hindered development of the forestry industry,weakening the economic foundation of rural governance.Ultimately,it results in the inefficiency dilemma of rural governance in mountainous areas.The strengthening of collective forestland property rights can resolve legal discrimination by improving the intensity of property rights,stabilize business expectations by extending the duration of property rights,and break through capacity constraints by expanding the scope of property rights,thus continuously shrinking the public domain of collective forestland property rights from the aspects of institutional design,time dimension and the exercise of rights.With the continuous deepening of the collective forest tenure system reform,the reform not only reshapes rural trust systems and constructs interest linkage mechanisms,but also improves the allocation efficiency of resource factors,thereby advancing the optimization and modern transformation of rural governance structures in mountainous areas and ultimately achieving effective rural governance.This study offers a new theoretical perspective for understanding the internal correlation between the collective forest tenure system reform and the modernization of rural governance,and also provides practical implications for further deepening the reform.关键词
