Establishment of Data Rights and Interests for Unmanned Aircraft in Low-Altitude Economy Scenarios
摘要
Abstract
Low-altitude operations conducted by unmanned aircraft constitute the main application scenarios of the low-altitude economy.Establishing a rights and interests system for the data generated in these scenarios is conducive to the legal operation of the low-altitude economy.The data collection methods of unmanned aircraft in low-altitude economy scenarios are unique,and the data collected involve numerous legal entities and encompass a wide variety of types.Granting legal entities involved usufruct over such data as a whole can not only accommodate the aforementioned unique characteristics but also promote the development and utilization of the data.This should be the foundation for constructing the rights and interests system for the data.On this basis,the legal entity storing the data shall designate a person in charge of personal information protection and a person in charge of network data security,thereby providing an institutional framework for the protection of personal information and important data.The principle of purpose limitation should be applied to delineate the usufruct of the data-storing entity.Drawing on comparative law,unfair terms in data-sharing agreements between the data-storing entity and other legal entities should be regulated,and corresponding compensation principles should be established for circumstances in which state authorities require the data-storing entity to share data.关键词
