On Environmental Law Response to the Construction of a Beautiful China
摘要
Abstract
The construction of a"Beautiful China"must adhere to the leadership of the Party,centreing around the people,and focusing on a beautiful ecological environment.Strengthening the rule of law as a safeguard for constructing a Beautiful China is based on improving and reinforcing environmental governance.China's environmental governance in terms of legislation,judiciary,and the coordination between judicial and administrative enforcement does not fully meet the legal safeguard requirements for constructing a Beautiful China.Against the background of this national initiative,Chinese environmental law should transition from a harm-free philosophy to an aesthetic one,and from a segregated approach to a systemic legal philosophy.Based on the renewal of environmental law concept,the following three aspects should be prioritized to improve and strengthen China's environmental governance:advancing the legislative development of pollution prevention and ecological protection to perfect the environmental legislative structure;enhancing the judicial protection of private environmental interests and integrating civil public interest litigation with ecological damage compensation system to promote the specialized development of environmental judiciary;and by complementing and supervising the functions of administrative and judicial powers in public interest litigation,strengthening the collaborative cooperation between environmental judiciary and administrative enforcement.关键词
