Research on the Challenge of Algorithmic Administration to the Principle of Due Process and Legal Regulation
摘要
Abstract
The increasing integration of artificial intelligence and public administration has resulted in the administrative paradigm change with the core of algorithmic power.Algorithmic administration has been widely used.However,the existence of the algorithm"Black Box",the absence of the executive branch in the process of the algorithm administration,and the absence of the relative person in the administration cause the crisis of the administrative due process.How to realize the return of algorithmic administration to the track of modern administrative rule of law accords with the theory of administrative rule of law.To establish technical and legal regulations,to conduct research on the three dimensions of pre-operational algorithm model design,in-process decision review and auxiliary discretion rules,and post-operational evaluation and supervision,and to maintain the legitimacy of algorithm administration procedures,to ensure that the algorithm of administrative governance in the country get a good application,to promote"Artificial Intelligence for good."关键词
