基本公共教育服务供给中的国家给付义务论析
Analysis of the State Payment Obligations in the Basic Public Education Service Supply Mechanism
摘要
Abstract
The provision of basic public education services is aimed at equalization,but the goal of providing equal basic public education services to all people of school age has not yet been achieved.The provision of basic public education services is the fulfilment of the State's obliga-tion to pay in the field of education,and since the value of the State lies in the realization of the State's purpose of protecting the fundamental rights of citizens,the obligation to pay is a State ob-ligation,a measure that the State must take to safeguard the fundamental rights of citizens.In ac-cordance with the right to education stipulated in the Constitution of China,the right to education involved in the provision of basic public education services is being transformed into the right to fair and high-quality education.However,when fulfilling the State's obligation to pay for the provision of basic public education services,there are problems such as insufficient equalization of in-kind payments,fragmentation of service payments,and lagging and systemic deficiencies in institutional payments.To solve the above problems,based on the"right-duty"framework of public law,we should clarify the scope of the government's payment,the allocation of profession-als and degrees,and the obligations of the state and local basic public education service provision standards;construct public-private cooperation mechanisms,confirm the responsibility of the state's guarantee,and strengthen the obligation to supervise the platform;and advocate the com-pilation of a code of education,which will include the state's obligation to pay for public educa-tion services.Advocating the compilation of a code of education,and embedding in the code of education the State's obligation to pay in the provision of basic public education services.关键词
