Reverse Connection between Criminal and Administrative Penalties in the Field of Food Safety:Dilemmas and Improvement Paths
摘要
Abstract
The reverse connection system between administrative and criminal law enforcement in the field of food safety,which reflects the value iteration from conviction-centered punishment to holistic governance,is an inevitable requirement to complete the governance chain of food safety and an important means to strengthen the legal supervision of procuratorial organs.However,in practice,this system faces three dilemmas:the misalignment of substantive norms,the obstruction of procedural operation,and the lag of supporting mechanisms.Therefore,it is necessary to adopt the governance stance of the"unitary coherence theory"to improve the normative system,strengthen top-level design,smooth the transfer procedure,clarify the connection rules,enhance information sharing,and optimize procuratorial supervision.This will activate the institutional function of the reverse connection between administrative and criminal law enforcement in the field of food safety from multiple dimensions such as substantive norms,procedural rules,and supporting mechanisms,thereby effectively enhancing the governance capacity and level of food safety.关键词
